These Terms and Conditions (“Terms”) govern your use of the Victory Freight Services website and the logistics, freight forwarding, and related services provided by Victory Freight Services (Pty) Ltd (“VFS”, “we”, “us”, or “our”). By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Services
Victory Freight Services provides freight forwarding, air freight, sea freight, road & rail transport, project logistics, customs clearance, cargo insurance, supply chain management, and related value-added services.
All services are subject to these Terms, our Privacy Policy, and any specific quotation or service agreement.
2. Quotations and Pricing
- All quotations are valid for 30 days unless otherwise stated.
- Prices are subject to change without notice due to fuel surcharges, currency fluctuations, carrier rate changes, or other external factors.
- Final charges may vary based on actual weight, volume, dimensions, and applicable surcharges.
- All prices are exclusive of VAT unless stated otherwise.
3. Bookings and Payments
- A confirmed booking requires written acceptance of our quotation.
- Payment terms are as agreed in the quotation or invoice. Full payment is required before shipment unless credit terms have been approved.
- Late payments will attract interest at 2% per month.
- We reserve the right to withhold goods or services until full payment is received.
4. Cargo Insurance
- We strongly recommend that clients obtain adequate cargo insurance.
- Unless specifically arranged and confirmed in writing, VFS does not provide cargo insurance.
- Where insurance is arranged by VFS, it is subject to the terms and conditions of the insurer.
5. Liability and Limitations
- Our liability for any loss or damage to cargo is limited to the lesser of:
- The actual value of the goods, or
- The standard industry limits (e.g., CMR, Hague-Visby Rules, or as per carrier terms).
- We are not liable for indirect, consequential, or punitive losses.
- We are not responsible for delays caused by customs, port authorities, weather, strikes, or events beyond our control.
6. Customs and Regulatory Compliance
- The client is responsible for providing accurate and complete documentation.
- You warrant that all goods comply with applicable laws and do not include prohibited or dangerous items without proper declaration.
- We may refuse to handle any shipment that violates laws or safety regulations.
7. Force Majeure
We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to acts of God, war, strikes, pandemics, government restrictions, or natural disasters.
8. Claims
- All claims for loss or damage must be submitted in writing within 7 days of delivery (or expected delivery for non-delivery).
- Claims must be supported by proper documentation, including survey reports where applicable.
9. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
10. Amendments
We reserve the right to amend these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.
